JUSTICE MOHIT KUMAR SHAH ORAL ORDER 27-08-2019 The present writ petition has been filed for removal of the encroachment over the government land which is the water source and public land appertaining to Khata No. 92, Khesra No. 173, 174, 175, area measuring 0.44, 2.82 and 0.21 total area 3 acre 47 decimal, situated at Mauza Naugarh, Revenue Thana No. 805, P.S. Bhagwanpur, District Kaimur at Bhabua. The learned counsel for the petitioner submits that an Encroachment Case No. 16 of 2017-18 is pending before the Circle Officer, Bhagwanpur, District Kaimur at Bhabua, but no action has been taken.

Having regard to the limited prayer made by the petitioner herein, I deem it fit and proper to dispose of the

Patna High Court CWJC No.17501 of 2019(2) dt.27-08-2019 2/2 present writ petition with a direction to the Circle Officer, Bhagawanpur, District Kaimur at Bhabua to take immediate steps for disposal of the said Encroachment Case No. 16 of 2017-18 in accordance with the provisions contained in the Bihar Public Land Encroachment Act, 1956.

The writ petition stands disposed of on the aforesaid terms.
