The petitioner apprehends his arrest in Kudra P.S. Case No. 220 of 2014, arising out of Complaint Case No. 1365 of 2014 registered for the offences punishable under Sections 304(B), 201 and 34 of the Indian Penal Code.

The informant made allegation that the petitioner and his family members killed Krishnawati Devi due to nonfulfillment of demand of dowry. It is submitted that the petitioner is husband. Before institution of this case the petitioner has filed Complaint Case No. 1186 of 2014 alleging therein that his wife went along with her brother-in-law namely Kameshwar Pal. It is further submitted that during course of investigation all the witnesses have stated that the

On such consideration co-accused Manohar Pal, Sheopati Debi, Anil Pal and Vijanta Debi have already been enlarged on anticipatory bail vide order passed in Cr. Misc. No. 9633 of 2015 on 26.08.2015. It appears that, of course, the petitioner is husband, but during the course of investigation almost all the witnesses have stated that the wife of the petitioner went along with her brother. Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhabua in Kudra P.S. Case No. 220 of 2014, arising out of Complaint Case No. 1365 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
