The petitioner seeks bail in connection with Saraiya P.S. Case No. 456 of 2014 registered for the offences punishable under Sections 394 and 328 of the Indian Penal Code. The petitioner is not named in the F.I.R. his name came in confessional statement of co-accused, nothing has been recovered from possession of the petitioner, he is in custody since 19.02.2015 but he has not been put on T.I.P. and similarly situated other co-accused namely, Krishna @ Vikky, Bikky Paswan @ Bikky Kumar, Md. Sarfaraj Alam @ Monu have been allowed bail by another co-ordinate Bench of this Court.

No.49448 of 2015 (2) dt.11-12-2015 2/2 In the facts and circumstances stated above, the petitioner is also directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., West Muzaffarpur arising out of Saraiya P.S. Case No. 456 of 2014 subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
