The petitioner has renewed his prayer for grant of bail in a case registered under sections 30(a), 36, 41(i) and (ii) of the Bihar Prohibition and Excise Act, 2016. The earlier application for bail of the petitioner was rejected vide order dated 12.4.2022 passed in Cr. Misc. no.61922 of 2021.

As per the prosecution case, the six accused persons including the petitioner herein was caught and on search, 2148.75 litres of liquor was recovered.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. He is in custody since 9.8.2021 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the nature of allegation, the liberty granted in the earlier order of rejection dated 12.4.2022 and the petitioner having remained in custody for more than 1 year since 9.8.2021, the Court directs the petitioner to be enlarged on bail in connection with Special Case no.4905 of 2021 (arising out of Maner P.S. Case no. of 580 of 2021) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise), Patna.
