JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 02-11-2015 Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the State. This application for grant of regular bail arises out of Motihari Town P.S. Case No.463 of 2015, disclosing offences under Section 387 of the Indian Penal Code. As per the prosecution case, the informant is said to have received a call on his mobile phone, asking him to pay a sum of Rs.20,00,000/-. The number of the

Learned counsel, appearing on behalf of the petitioner, submits that the petitioner has no criminal antecedent and false case has been instituted against him by the informant because of dispute over accounting with respect to payment of wages to the informant. Considering the nature of accusation and submission, as above, this application is allowed. The petitioner, abovenamed, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari, in connection with Motihari Town P.S. Case No.463 of 2015.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required, and in the event of failure on his part to appear before the Court, on two consecutive occasions, his bail bond shall be liable to be cancelled.
