The petitioner apprehends her arrest in connection with Shastri Nagar P.S. Case No.448 of 2016 registered under Sections 409 and 420 of the Indian Penal Code.
The accusation is that out of the estimated amount of Rs.17,15,300/- for the construction of the building of the Government Vani Mandir Middle School, Rajwanshi Nagar (Patel Nagar), Patna, Rs.15,43,770/- and Rs.2,24,804/- for the construction of the boundary wall and Rs.50,000/- for the sports were sanctioned in the financial year 2006-2007. The petitioner being the Headmistress and Kiran Kumari being the Secretary of
Patna High Court Cr.Misc. No.46267 of 2017 (2) dt.12-10-2017 2/3 the Education Committee of the said School did not follow the guidelines as issued by the Bihar Education Project and also did not get the construction work completed of the building of the said School.
Learned counsel appearing on behalf of the petitioner submits that the petitioner has retired from the post of Headmistress of the said School and before retirement, the petitioner had got constructed the school building but the informant, who is the School Sub Inspector, with an ulterior motive has lodged the present case. After lodging of the present case, the husband of the petitioner filed an application before the District Magistrate, Patna, who got enquired the matter through the S.D.M., Patna, Sadar, and it has been reported by the Executive Magistrate, Patna, Sadar, that the work has been completed according of the norms, which would appear from Annexure-'4' to this application.
Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of her arrest or surrender by her within six weeks from today, be enlarged on bail on her furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Smt. Aditi Gupta, Judicial Magistrate, First Class, Patna, in
