JUSTICE SANJAY PRIYA ORAL ORDER 09-10-2018 Heard learned counsel for the petitioner, the C.B.I. and the learned A.P.P. for the State.
The petitioner seeks bail in RC No. 22(A)/2015, corresponding to SPL. Case No. 2/2016, instituted for the offences under Sections 120B, 420, 467, 468 and 471 of the Indian Penal Code read with Sections 13(2) and 13(1)(d) of Prevention of Corruption Act, 1988.
It is alleged against this petitioner that he was appointed as Gramin Dak Sevak in the post office by Sri Arvind Kumar Kesari, then Inspector of Post, West Sub Division, Nawada on the basis of fake certificate issued by Bihar Sanskrit Siksha Board.
Learned counsel for the petitioner has submitted
Patna High Court Cr.Misc. No.57572 of 2018 (2) dt.09-10-2018 2/2 that the officers of the post office who were responsible for appointment have not been made accused in this case. It is further submitted that other accused persons with similar allegation has already been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. Nos. 24383/2015 dated 12.08.2015 and 24383/2015 dated 12.08.2015.
Learned counsel for CBI has opposed the prayer for bail of the petitioner.
Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Praveen Kumar Singh, Judicial Magistrate, C.B.I. 1, Patna in connection with RC No. 22(A)/2015, corresponding to SPL. Case No. 2/2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
