The petitioner apprehends his arrest in connection with Rajoun P.S. Case no. 164 of 2017, registered under Sections 147, 149, 341, 323, 307, 379 and 504 of the Indian Penal Code. The accusation is that on 12.05.2017 at about 9.30 P.M. Nitish Kumar, cousin of the informant, was standing on the gate at that time, six persons named in the F.I.R. including the petitioner reached there and started to abuse his cousin brother and they also started pull him towards the field, when the informant made protest then this petitioner caused injury to him. At that time, Rajesh Yadav snatched Rs. 2000/- from the pocket of the informant.
Learned counsel for the petitioner submits that, in fact, occurrence of Marpit took place due to land dispute in which petitioner
Patna High Court Cr.Misc. No.42375 of 2017 (2) dt.19-09-2017 2/2 side also sustained injury regarding which Rajoun P.S. Case No. 163 of 2017 was also instituted on the basis of the written report of the petitioner.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka in connection with Rajoun P.S. Case No. 164 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
