The petitioner is languishing in judicial custody since 10.10.2016 in connection with Complaint Case No. C2/307/2016 for offences alleged under Sections 30(a) of the Bihar Excise (Amendment) Act, 2016.
The complaint case, as lodged by the Excise Officials, is that the petitioner is the resident of Nonahi under Parihar Police Station of Sitamarhi, District situated near IndoNepal Boarder, he was apprehended with 9 litres of Soufi wine and accordingly, the seizure list was prepared. It has been submitted by the counsel for the petitioner that the petitioner is innocent, has not committed any offence, has
Patna High Court Cr.Misc. No.52809 of 2016 (2) dt.22-12-2016 2/2 no criminal history and has falsely been implicated in the aforesaid case. Nothing has been recovered from the conscious possession of the petitioner.
However learned AP.P. for the State submits that the petitioner is named in the complaint, hence opposes the prayer for bail Be that as it may, considering the aforesaid facts and circumstances and submission of the parties, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Complaint Case No. C2/307/2016.
