JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 15-10-2015 The petitioner apprehends his arrest in relation to Koilwar P.S. Case No. 124 of 2015 , instituted under section 366/366(A) of the Indian Penal Code.

It is alleged that the petitioner has enticed away the minor daughter of the informant for the purpose of illegal intercourse. Learned counsel for the petitioner points out that the girl has not yet been recovered, and as such how it could be said that she has been enticed away for intercourse. He further submits that the F.I.R. itself has been lodged four months after the disappearance of the girl. If the informant was sanguine that the petitioner had enticed her, he would have known it at the very beginning. Except the uncorroborated and unsupported statement of the informant, there is nothing in the case. The petitioner is

Be that as it may, I direct that in the event of arrest or surrender in the court below within four weeks, the above named petitioner shall be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate,Bhojpur at Ara in connection with Koilwar P.S. Case No. 124 of 2015, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
