The petitioner apprehends arrest in connection with Rajauli P.S. Case No. 281 of 2021 registered under Section 414 of the Indian Penal Code and Section 30(a), 37(c) of the Bihar Prohibition and Excise Act.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. From perusal of seizure list, it is evident that the alleged recovery has been made from the hut, which is situated in front of the house of the petitioner. Petitioner has no concern with the recovered articles. Further he submits that neither the alleged motorcycle nor the place of occurrence belongs to the petitioner. Petitioner has no criminal

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Additional Sessions Judge-IIcum-Special Judge, Excise Act, Nawada in connection with Rajauli P.S.
