Petitioner seeks bail in a case registered for the offences punishable under Sections 20B/22/23/24 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

More than 3 Kg. Charas was, allegedly, recovered from the possession of the petitioner. Petitioner is in custody since 15.09.2015.

Submission is that the petitioner has got no criminal antecedent.

Considering the nature of allegation against the petitioner, I am not inclined to enlarge him on bail in connection

Patna High Court Cr.Misc. No.53762 of 2016 (4) dt.06-03-2017 2/2 with N.D.P.S. Case No. 49 of 2015 arising out of Palanwa Police Station Case No. 92 of 2015 pending in the Court of learned SubDivisional Judicial Magistrate, Raxaul, East Champarant at Motihari, for the present.

However, the petitioner may renew his prayer for bail if the trial is not concluded within nine months from today. The learned court below is directed to expedite the trial since the petitioner is in custody since last two years. Kundan (Birendra Kumar, J) U T
