The petitioners seek bail in a case registered under Section 341, 323, 353, 379, 504/34 of the Indian Penal Code and Sections-62 & 63 of Indian Forest Act.
Allegation against the petitioners is of cutting Sheesham trees, planted on the land of District Board. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are in custody since 17-07-2019. Two Sheesam trees of District Board are said to have been cut
Patna High Court CR. MISC. No.54732 of 2019(2) dt.30-08-2019 2/2 by the petitioners. The petitioners have been made accused in the present case due to mistake of fact. The Sheesam trees, in question belong to the petitioners.
On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Saran at Chapra in connection with Parsa P.S. Case No. 41 of 2019.
