2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 323, 307 and 34 of the Indian Penal Code and section 27 of the Arms Act.

3. The case of the prosecution is that two persons opened fire upon the informant as a result of which the bullet first hit the hand of the informant and after passing through the palm, hit the stomach of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that in the case, petitioner was apprehended by the police and allegedly

It is further submitted that save and except the confessional statement of the petitioner, there is no direct allegation or material against the petitioner. It is also submitted that no Test Identification Parade (TIP) was conducted. Moreover, the petitioner has been languishing in judicial custody since 29.06.2024.

5. Learned APP appearing for the State has opposed the prayer of regular bail submitting that the petitioner has four criminal antecedent.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Koilwar P.S. Case No. P.S. Case No. 147 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara.
