JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 20-05-2015 Heard learned counsel for the petitioners in support of the application which seeks restoration of S. A. No. 345 of 2013 by extending the peremptory time granted under order dated 11.09.2014 whereby three weeks time was allowed to remove the defects.

Counsel for the petitioners relying on the statement made in paragraph 2 of the petition states that all the defects were removed within time on 26.09.2014. However, the typed copy of the decree under appeal could be filed after expiry of period on 09.10.2014. He has explained the reasons therefor. For the reasons stated in the application and submissions made in support thereof the same is allowed. The time granted under order dated 11.09.2014 passed in S.A. No. 345 of 2013 is extended to 09.10.2014 subject to deposit of Rs. 250/-
