JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 25-11-2022 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. Petitioner apprehends his arrest in connection with Lalganj P.S. Case No.80 of 2022, registered for the offence punishable under Section 30(d) of the Bihar Prohibition and Excise Act.

700 litres of raw Java and other articles used in manufacturing of illicit liquor have been recovered from Salempur Diyara area. The petitioner and other co-accused persons are said to have fled away from the place of occurrence after seeing the police.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioner has got no

Patna High Court CR. MISC. No.57754 of 2022(2) dt.25-11-2022 2/2 criminal antecedent as stated in paragraph-3 of the bail applications. The Chowkidar has disclosed the name of the petitioner. It is further submitted that there is no recovery from the conscious possession of the petitioner.

The learned APP for the State opposed the prayer for anticipatory bail of the petitioner and submitted that the petitioner is involved in manufacturing of illicit liquor. Considering the fact that the petitioner is member of the syndicate involved in manufacturing of illicit liquor, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
