This application has been filed on behalf of the petitioner for modification of the order dated 03.04.2014 passed in Criminal Misc. No.10454 of 2014 by a Bench of this Court to the extent to allow to deposit total amount of 06 months, i.e., Rs.18000/-, in advance and the same should be adjusted or treated to be installment @ Rs.3000/- per month on the place of "deposit Rs.3000/- per month in the court below by 15th of every month". It appears that vide order dated 03.04.2014 passed in Criminal Misc. No.10454 of 2014 by a Bench of this Court, while issuing notice to the opposite party no.2, in the meanwhile, the

Patna High Court Cr.Misc. No.40187 of 2017 (2) dt.19-09-2017 2/3 petitioner, above named, was directed to be released on provisional anticipatory bail till further orders, in the event of arrest or surrender before the learned court below within a period of four weeks from the date of receipt of the aforesaid order, on furnishing bail bond of Rs.5000/-(Five Thousand) with two sureties of the like amount each or any other surety as fixed by the court to the satisfaction of Sri Ravi Ranjan, Judicial Magistrate, First Class, Patna (or its successor) in connection with Buddha Colony P.S. Case No.

178 of 2013 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as also subject to the conditions that one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the court if there is any change in the address of the petitioner. The petitioner was further directed to deposit Rs.3000/-(Three Thousand Rupees) per month in the court below firstly within 15 days from the date of receipt of the aforesaid order and subsequently by 15th every month which the wife of the petitioner will be at liberty to withdraw without prejudice the right of the parties. The court below shall inform the wife of the petitioner about the present order.

Patna High Court Cr.Misc. No.40187 of 2017 (2) dt.19-09-2017 3/3 a Bank Account, the money shall be deposited in the Account and a receipt to this effect shall be filed by 15th every month in the court below and in case he fails to do so his provisional anticipatory bail would be automatically cancelled. Later on, the provisional bail was confirmed on 01.07.2015 on same terms. I find no reason to modify the order dated 03.04.2014 passed in Criminal Misc. No.10454 of 2014 by a Bench of this Court.
