JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 27-06-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 409, 477 of the Indian Penal Code.

It is alleged by the informant that he runs Customer Service Centre and employed the petitioner in his Centre as Computer Operator but he had misappropriated Rs. 20-25 lakhs of the public by transferring their money into his account.

It is submitted by learned counsel for the

Patna High Court CR. MISC. No.60102 of 2022(4) dt.27-06-2023 2/3 petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner was working as Computer Operator in the centre of the informant and he was paid monthly salary for his work. The petitioner had no concern with any kind of financial work. The petitioner had already given Rs. 1,55,000/- to the informant and a panchnama to that effect was made on 04.08.2019 and thereafter on 28.08.2019, the informant had filed the present F.I.R with ulterior motive. A supplementary affidavit to that effect has been made in para 2 and 3 of the petition. The petitioner is languishing in custody since 26.02.2022.

Learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount
