1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners seek bail in a case registered for the offences punishable under Sections 188 and 290 of the Indian Penal Code as well as Sections 30(a) and 32(3) of the Bihar Prohibition and Excise Act, 2018.

3. Learned counsel for the petitioners submits that petitioners are person with clean antecedent and are in custody since 19.07.2024.

4. Allegation is of recovery of 378 litres of liquor from a pickup.

5. Learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.62696 of 2024(3) dt.21-09-2024 2/2 petitioners are not the owner of the seized vehicle and came to be implicated in the instant case on the ground that they were passing from the area where search was being made.

6. Learned A.P.P. for the State opposes the prayer for regular bail of the petitioners.

7. Considering the submissions aforesaid, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Excise P.S.
