JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-12-2016 Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner seeks anticipatory bail in connection with Nauhatta P.S. Case No. 107 of 2016 instituted for the offences punishable under Sections 302/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that though the petitioner is named in the F.I.R., nothing has been alleged against the petitioner except the suspicion and the petitioner was not present at the time of the occurrence. Heard the learned APP also.

Considering the aforesaid facts and circumstances,let the petitioner surrenders before the court

Patna High Court Cr.Misc. No.52887 of 2016 (2) dt.22-12-2016 2/2 below and the court below will examine this aspect of the matter and examine the submission of the learned counsel of the petitioner and if it is found to be true, the petitioner shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the court below otherwise the learned court below is free to pass any order on the merits of the case without being prejudiced of the order of this Court.
