JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-05-2024 The present writ petition has been filed seeking the following relief:- "1. That this is an application praying for issuance of a Writ in the nature of Mandamus, or any other appropriate Writ order, direction commanding the Respondents, particularly the Respondent No. 6 to forthwith decide and dispose of the representation of the Petitioner dated 05.02.2014 (Annexure-12). The Petitioner further prays for a consequential Writ of
Patna High Court CWJC No.11099 of 2014(3) dt.01-05-2024 2/2 Mandamus commanding the Respondent No. 6 to ensure that the encroachment on public land pertaining to Khata No. 133, Khesra No. 679, Thana No. 297, at VillageBahurwa, District- West Champaran, made by the Respondent No. 12 is removed forthwith in view of the written undertaking given by the Respondent No. 12, by his letter dated 01.10.2013 to the Respondent No. 6."

At the outset, the learned counsel for the petitioner submits that since the petitioner has died during the interregnum period, his son be granted liberty to agitate his grievances regarding removal of the encroachment in question by taking recourse to such remedies as are otherwise available under the law. Liberty, so sought, is granted.

According, the writ petition stands disposed off.
