The petitioner seeks bail in K.Nagar P.S. Case No.114 of 2019 registered under Sections 304B/34 of the Indian Penal Code.

The brother of the informant disclosed that after marriage, his sister Archana Devi was subjected to torture at the hands of the petitioner. After 1 1⁄2 years ago also, his sister was burnt by the petitioner and she remained under treatment for months. On 30.03.2019 at about 7.00 A.M. the informant got information that his sister was killed in her matrimonial house. When the informant went there, he found dead body of his sister lying.

Learned counsel for the petitioner submits that wife of the petitioner died due to electric shock and the petitioner gave

Patna High Court CR. MISC. No.57707 of 2019(3) dt.20-11-2019 2/2 information to the informant regarding death of Archana Devi. He further submits that the petitioner never assaulted the deceased and marriage was solemnized about five years ago, but it appears from the postmortem report that Archana Devi appears to have died due to injury and viscera report was kept reserved. There is no case of death of Archana Devi due to electric shock. The petitioner is husband of Archana Devi (deceased) and on earlier occasion also, the deceased had got burn injury on her both thigh.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
