Mr. Jitendra Kumar Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-09-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Fenhara P.S. Case no. 21 of 2011, registered under Sections 147, 148, 149 and 435 of the Indian Penal Code and Section 17 of C.L.A. Act.

The accusation is that tower of Airtel company was installed at the land of Ramashray Puri in village-Rajepurkol, Madpamal. On 22.03.2011 at about 11.00 A.M. informant Murlidhar Prasad Singh being the technician received information about putting of fire on the tower by 40-50 miscreants. On the next morning, when the informant reached there then found P.I.U, Power Plant, Shelter Room, Mohul, I.D.U stand, wire and fan were burn to ash.

In course of investigation one Sikandar Sahani was apprehended by the Police, who confessed his guilt and he also disclosed the name of petitioner and others as his associates. Further submission is that, in fact, Sikandar Sahani known to the petitioner and due to that reasons, he disclosed the name of petitioner. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M-XII, Motihari, East Champaran in connection with Fenhara P.S. Case No. 21 of 2011, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
