2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 392 of the Indian Penal Code.

3. The case of the prosecution is that the informant, while returning back from Sitamarhi to Muzaffarpur was intercepted near Gopalpur bridge at about 9: 15 P.M., when three miscreants riding on a motorcycle overtook him and at gunpoint, snatched away his motorcycle.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case.

It is further submitted that the FIR has been lodged

Patna High Court CR. MISC. No.58347 of 2025(2) dt.27-08-2025 2/2 against unknown miscreants. The petitioner was subsequently arrested in Hathori P.S. Case No. 151 of 2022 wherein it is alleged that he made a confessional statement and on the basis of that confessional statement, he has also been remanded in the present case as well. It is also submitted that the petitioner has criminal antecedent in two other cases, as mentioned in paragraph 107 of the case diary. Moreover, the petitioner has been languishing in judicial custody since 10.06.2022 and nothing substantial has been recovered from him in connection with the present case.

Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Hathauri P.S. Case No. 61 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Muzaffarpur (East).
