The petitioner seeks bail in connection with Dinara (Bhanas) P.S. Case No. 180 of 2016 instituted for the offences punishable under Sections 272, 273 of the Indian Penal Code and under Sections 54 and 57 of Bihar Excise Act. In substance, the allegation is that the police party apprehended this petitioner while he was carrying 25 lts. foreign liquor.

Contention of the petitioner is that he has falsely been implicated in the present case. Nothing incriminating materials has been recovered from his conscious possession. The petitioner is in custody since 20.08.2016.

The learned APP for the State has opposed the prayer

Patna High Court Cr.Misc. No.54206 of 2016 (2) dt.21-12-2016 2/2 for bail to the petitioner.

Considering the facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Bikramganj, Dist.-Rohtas in connection with Dinara (Bhanas) P.S. Case No. 180 of 2016 subject to the condition that:

(i) The petitioner shall appear in person on each date fixed at the trial. In case of default in appearance on two consecutive dates, the trial court shall have liberty to cancel his bail bonds.
