Mr. SRI INDRA KUMAR SINGH ====================================================== CORAM: HONOURABLE MR. JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 19-09-2017 Heard learned counsel for the petitioners and learned APP representing the State.

The petitioners apprehend their arrest in connection with Benipatti P. S. Case No. 67 of 2017 registered for the offences punishable under Sections 363, 366A of the Indian Penal Code. Allegedly, the petitioners and other co-accused kidnapped the minor daughter of the informant. During investigation the statement of the victim girl was recorded under Section 164 Cr.P.C. wherein she has not named the petitioners and she has specifically stated the name of only Md. Sahjad and as such the petitioners deserve sympathetic consideration. Learned APP after going through the statement of the victim recorded under Section 164 Cr.P.C. fairly submits that the petitioners have not been named in that statement.

No.44053 of 2017(2) dt.19-09-2017 2/2 In the facts and circumstances stated above, the petitioners above named, in case of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order, are directed to be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Benipatti, Madhubani in connection with Benipatti P. S. Case No. 67 of 2017, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) avin/- U T
