====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-09-2025 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 8, 20 of the Narcotic Drugs and Psychotropic Substances Act, 1985.
3. According to F.I.R., 1.5 kg Ganja was recovered from the house of co-accused Anjali Kumari who disclosed that the aforesaid Ganja was brought by and given to her by this petitioner who wanted to use it to trap her brother-in-law.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. No Ganja or incriminating material has been recovered from conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State vehemently opposed
Patna High Court CR. MISC. No.58175 of 2025(2) dt.01-09-2025 2/2 the bail application.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Judge Court No. II, NDPS, East Champaran, Motihari in connection with Kalyanpur P. S. Case No. 128 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
