The petitioner seeks bail in Siwaipatti P.S. Case No. 26/2016, registered for the offences punishable under Sections 366(A)/34 and 504 of the Indian Penal Code.

The informant submitted written information before the S.H.O and alleged that on 04.03.2016 her full brother along with his daughter Bisti Kumari came to her house and on the same day one Amod Rai along with this petitioner also came at her house and forcibly took her niece in the mid night with him. It has been submitted on behalf of the petitioner that there was matter of love affairs and the victim has got married with the petitioner. It has been submitted that after 45 days of the occurrence this case has been lodged. Further it has been submitted that the girl is major, aged about 19 years and also filed

Patna High Court Cr.Misc. No.54221 of 2016 (2) dt.21-12-2016 2/2 marriage certificate. The petitioner has denied the allegation of kidnapping.

Learned Additional P.P. opposed the prayer for bail. From perusal of the record I find that both parties are known to each other. They have compromised the case. Learned counsel for the petitioner submitted that after compromise the petitioner is ready to keep the victim as wife. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge, Muzaffarpur in connection with Siwaipatti P.S. Case No. 26/2016.
