JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 17-10-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Khiri Mor P.S.Case No. 30 of 2017 registered under Sections 406, 420, 467, 468 and 471 of the Indian Penal Code. In the First Information Report it has been alleged that the petitioner being Sarpanch had no authority to appoint Nyay Mitra, but by putting the informant in complete dark, he appointed him on the post of Nyay Mitra and took work from him for about a year without making any payment and when the informant enquired from the Block Development Officer regarding non-payment of his wages, he was informed that his appointment was fake.

Having regard to the nature of the allegation, in the event of arrest or surrender before the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Danapur in connection with Khirimor P.S.Case No. 30 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
