The petitioner seeks bail in Ara Nawada P.S. Case No. 673 of 2020, registered for the offence punishable under Section 302 and other allied sections of the Indian Penal Code. FIR was lodged on recovery of dead body of the nephew of informant from the railway track and thereafter suspicion was raised that this petitioner and co-accused Ritesh Kumar Singh along with villagers committed murder of the deceased.

It is submitted on behalf of the petitioner that informant is not eye-witness of the occurrence and only on suspicion and due to old enmity petitioner has been made accused in this case. Similarly situated co-accused Ritesh Kumar Singh has been granted bail by this Court vide order

Patna High Court CR. MISC. No.69030 of 2021(2) dt.03-03-2022 2/2 dated 04.10.2021 passed in Cr. Misc. No. 17053 of 2021 (Annexure-2). Petitioner claims clean antecedent and he is in custody since 03.09.2020. Investigation is complete. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Nawada P.S. Case No. 673 of 2020.
