JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04/ 02.08.2017 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Learned Addl. Sessions Judge III, Barh (Patna) vide letter no. 107 dated 15.7.2017 reported that Sessions trial no. 759/2015 was earlier pending in the court of Addl. Sessions Judge I, Barh but by the order of learned Sessions Judge, Patna, aforesaid record was received in his court on 6.7.2017 and accordingly, he has sought four months' time for disposal of the aforesaid Sessions trial, though the aforesaid case is pending for argument.

I am unable to understand as to why Addl. Sessions Judge III, Barh has sought four months' time for disposal of the case, particularly, in the circumstance, when the aforesaid sessions trial is pending for argument.

However, in the aforesaid circumstance, Addl. Sessions Judge III, Barh is directed to dispose of Sessions trial no. 759/2015

Patna High Court Cr.Misc. No.53362 of 2016 (4) dt.02-08-2017 within two months from 15.7.2017.
