JUSTICE SHAILENDRA SINGH ORAL ORDER 18-09-2025 The instant writ petition has been filed by the petitioners under Article 226 of the Constitution of India seeking the following reliefs:- "(i) For a direction upon the respondent authorities the Nagar Palika, Buxar not to take the forceful possession of the Raiyati land of the petitioner and further also restrain the Nagar Palika, Buxar to construct any sort of building.

(ii) Further also direct the respondent authorities to consider on act upon te representation of the petitioner within the reasonable period.

Patna High Court CWJC No.14768 of 2025(2) dt.18-09-2025 2/3 (iii) Further also restrain the respondent authorities not to take forceful possession or construct any sort of structure during the pendency of the present sent writ application.

(iv) Pass such order/ orders which deems fit and proper in the present circumstances of the case."

2. Heard Mr. Ramanuj Tiwary, learned counsel for the petitioners and Mr. Braj Bhushan Mishra, learned AC to AAG 9 for the State- respondents.

The main grievance of the petitioners is that their ancestral land appertaining to Khata No. 583, Plot Nos. 1849 & 1850, area 2 acres and 20 decimal has been wrongly demarcated by the Buxar Municipality which is also creating disturbance in the peaceful possession of the petitioners over the aforesaid land and the petitioners have approached the District Magistrate, Buxar, the Circle Officer, Buxar and the Executive Officer, Buxar Municipality by filing an application (Annexure-P/3) but no action has been taken till date.

In view of the issue raised by the petitioners and having gone through the Annexure-P/3, this court finds that the aforesaid issue raised by the petitioners is premature for consideration by this court under writ jurisdiction. Accordingly, the instant writ petition stands disposed of with a direction to the District Magistrate, Buxar to look into the petitioners'

Patna High Court CWJC No.14768 of 2025(2) dt.18-09-2025 3/3 grievance and take necessary legal steps as per law if the petitioners have a bonafide issue relating to abovementioned matter, within next three weeks.
