====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 13-09-2019 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case for the offence registered under Sections 379 and 457 of the IPC. The prosecution story, in brief, is on 11.05.2018 at about 10.00 P.M., the informant and his entire family members were sleeping after taking meal. At about 5.30 A.M., when they woke up then saw that grill of window is open. On verification of house, it transpired that several ornaments are missing. It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 13.04.2019. The petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses

Patna High Court CR. MISC. No.57686 of 2019(2) dt.13-09-2019 2/2 alleged against the petitioner. The petitioner is not named in the F.I.R. The name of the petitioner has come on the basis of his self confessional statement made before the police. The recovered jewellery has not been put on T.I. Parade to ascertain whether the same is stolen property or not. The petitioner has not been put on T.I. Parade.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Judge-cum-Additional Chief Judicial Magistrate-VIII, Patna, in connection with Beur P.S.
