====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL JUDGMENT Date : 13-08-2024 Heard learned counsel for the petitioner, learned for the University and learned counsel for Hon'ble Chancellor.

2. By filing the present writ application, the petitioner has prayed for the following reliefs:

(I) For issuance of an order(s)/direction(s) or appropriate writ(s) for directing the concerned respondents to place the Synopsis submitted by the petitioner before the Departmental Research Council (DRC) meeting of History Department, J.P. University, Chapra and also before the Post

Patna High Court CWJC No.17300 of 2019 dt.13-08-2024 2/3 Graduate Research Council (PGRC) meeting of J.P. University, Chapra and thereafter issue PGRC letter to the petitioner permitting him to conduct further research and complete the Ph.D. within the prescribed time.

(II) For issuance of any other appropriate writ/writs, order/ orders, direction/directions for which the writ petitioner shall be found entitled under the facts and circumstances of the case.

Learned counsel for the petitioner submits that the petitioner visited the respondent Authority several times and requested them to take necessary action at the earliest so that PGRC letter be issued to the petitioner permitting him to conduct further research and complete Ph.D. within the prescribed time, but till date no further action has been taken by the respondent Authority nor any information in this regard has been given to the petitioner.

4. Learned counsel for the University submits that the concerned respondent received the approval of examiner from D.R.C. The Vice Chancellor has appointed two external and one internal examiner for dissertation/thesis vide order dated 09.05.2023 and letters have also been issued to them for their consent vide order dated 20.05.2023. It is further submitted that the respondent Authority has received consent letter from one external examiner and one internal examiner on 30.05.2023 and

Patna High Court CWJC No.17300 of 2019 dt.13-08-2024 3/3 06.03.2024, respectively, but consent letter of one external examiner has not been received. As such, a reminder letter has also been sent to the said external examiner on 07.03.2024, but till date no reply was filed by that external examiner.

5. In view of the aforesaid discussion, the petitioner is directed to file an application before the Registrar, Jai Prakash University, Chapra within a period of two weeks from today to change the said external examiner, whose consent letter has not been received yet.

6. It is needless to state that in case an application is filed, by the petitioner, the Registrar, Jai Prakash University, Chapra is well advised to consider the same, by passing a reasoned and speaking order within a period of two weeks after receiving of such application.

7. With the aforesaid direction, this writ application stands disposed of.
