====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 17-09-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks regular bail in connection with Harsidhi P.S. Case No. 263 of 2023 registered under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

3. There is recovery of 20 litres of country made liquor from the house of the petitioner.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case being the owner of the house. Further submission is that the house in question, from where the alleged recovery has been made, is a joint family property. Although, petitioner has 9 criminal antecedents but in most of the cases, he is on bail.

5. Learned A.P.P. for the State opposes the prayer for regular bail and submits that petitioner is a habitual offender having 9 criminal antecedents of similar nature and there is specific allegation that 20 litres of illicit liquor was recovered from the house of the petitioner.

6. Considering the facts and circumstances of the case, submissions of learned counsel for the parties and the fact that the recovery of illicit liquor from the house of the petitioner coupled with 9 criminal antecedents of similar nature, this Court is not inclined to grant regular bail to the petitioner. Accordingly, his prayer for regular bail is, hereby, rejected. (Sunil Dutta Mishra, J) utkarsh/- U T
