The petitioner apprehends his arrest in a case registered for the offence under Sections 419, 420, 120B of the Indian Penal Code and Section 10 of Bihar Examination Conduct Act.

It is a case of cheating by impersonation. In the F.I.R., it is alleged that some other person appeared in examination of 10th Bihar School Examination Board in place of this petitioner and was caught in the examination hall.

It is submitted on behalf of petitioner that petitioner was neither examinee nor appeared in the said examination. Name of the petitioner has come on the basis of statement of one Lal Bahadur. Petitioner claims clean antecedent. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Case No. 124 of 2014, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
