JUSTICE BIRENDRA KUMAR ORAL ORDER 16-01-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 498A/323/313 of the Indian Penal Code and Section 3⁄4 of the D.P. Act.

Petitioner is husband of the informant.

Allegation is of demand of dowry and torture. The petitioner is in custody since 04.09.2016. Petitioner has stated on oath in para-9 that he is ready to keep the informant with full honour, dignity and comfort.

In the aforesaid circumstances, in presence of learned counsel for the petitioner as well as the informant it is ordered that petitioner, above named, are directed to be released

Patna High Court Cr.Misc. No.55185 of 2016 (2) dt.16-01-2017 2/2 provisionally on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran/Successor Court, in connection with Harsidhi P.S. Case No. 166 of 2016.

The Court-below shall take appropriate step for re-conciliation between the parties either himself or through District Mediation Centre and thereafter shall pass appropriate order regarding the confirmation of the bail according to the circumstances of the case.
