The petitioner seeks bail in a case registered for the offence punishable under Sections 8, 20(B),(ii) (C), 25, 29 of the N.D.P.S. Act.

Learned counsel appearing for the petitioner submits that earlier the prayer for bail of this petitioner had been rejected by a co-ordinate Bench of this Court vide order dated 06.11.2018 passed in Cr. Misc. No. 62267 of 2018 with liberty to renew the prayer for bail after nine months if no substantial progress is not made in trial. From perusal of the report received from the Additional Sessions Judge-1st-cumSpecial Judge, NDPS Act, Begusarai, it is evident that the trial

Patna High Court CR. MISC. No.59538 of 2019(5) dt.15-02-2020 2/2 is still going on the stage of evidence although more than a year has passed and there is no likelihood of conclusion of trial in near future. The petitioner is rotting in judicial custody since31.05.2018.

Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-I -cumSpecial Judge, N.D.P.S.
