The petitioner is accused in connection with Bibhutipur P.S. Case No. 91 of 2015 registered under Section 364A of the Indian Penal Code.

The accusation is that on call of co-accused, Sarwan Sah, husband of the informant moved on 14.05.2015 at Narhan for job but husband of the informant did not return. On next day, in the morning, informant received information at her mobile regarding kidnapping of her husband and Rs.2,00000/- was demanded as extortion money to set free her husband. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. rather in course of investigation petitioner has falsely been implicated in this case

Patna High Court Cr.Misc. No.48333 of 2015 (2) dt.30-10-2015 mere on suspicion. It is further submitted that victim, Yogendra Sah, was recovered by the police along with co-accused, Sharwan Sah, where the petitioner was also present there. It is further submitted that victim, Yogendra Sah, in his statement, under Section 164 of the Cr.P.C., has not stated about any overt act against the petitioner. It is further submitted that petitioner has no criminal antecedent and is in custody since 18.05.2015. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the J.M. Ist Class, Rosera, in connection with Bibhutipur P.S. Case No. 91 of 2015.
