The petitioner seeks bail in Itarhi P.S. Case No. 290 of 2021, registered for the offence punishable punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018. 86.4 litres of foreign liquor has been recovered from Scorpio vehicle and this petitioner and three others were sitting in the said vehicle and started fleeing away after seeing the police party and three persons including this petitioner were apprehended on the place of recovery.

It is submitted that no recovery has been made from conscious possession of this petitioner. Petitioner is neither driver nor owner of vehicle in question and he has got no concern with the seized liquor. Petitioner is in custody since

Considering the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cum-Special Judge Excise Act, Buxar in connection with Itarhi P.S.
