The petitioner seeks bail in a case instituted for the offence punishable under Section 307 of the Indian Penal Code and under Section 25(1-b)A, 26,27 of the Arms Act. It is alleged against the petitioner that he fired shot from a pistol at the tea shop stall of the informant. It is further alleged that petitioner was apprehended from the place of occurrence with a country made pistol.

Seizure list is available with the F.I.R wherein it is mentioned that pistol has been recovered from near tea shop stall of the informant. Seizure list does not disclose the alleged fire arm was recovered from possession of the petitioner. It further appears

Patna High Court Cr.Misc. No.53678 of 2016 (2) dt.14-12-2016 2/2 that no injury has been caused to anybody. It is merely alleged that petitioner fired from his country made pistol. It is submitted that petitioner is in custody since 20.05.2015.

In the aforesaid circumstances and keeping in view the period already spent by the petitioner in custody and in fact no injury caused to anybody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional District Judge-II, Bhagalpur in connection with Nathnagar (Madhusudanpur) P.S.
