JUSTICE PRABHAT KUMAR JHA ORAL ORDER 14-12-2015 Heard both sides. The petitioners apprehend their arrest in a case under sections 3, 4, 5, 6 and 7 of the Immoral Traffic(Prevention)Act, 1956.
The petitioners are owners of Dayal Rest House. It is submitted that the Managers of the Guest House were apprehended on the spot, and on search three women and three men were recovered. The Managers of the Guest House allotted the rooms. The persons apprehended disclosed that the women are their wives and relatives. Even during the course of investigation, the apprehended women made their statements under section 164 of the Code of Criminal Procedure, and they altogether denied to have come for prostitution.
Patna High Court Cr.Misc. No.50883 of 2015 (2) dt.14-12-2015 2/2 Considering the aforesaid facts, the above named petitioners, who are the owners of the Guest House, in the event of arrest or surrender in the court below within four weeks from the date of receipt/production of a copy of this order, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection Khagaria P.S. Case No. 531 of 2015, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure, 1973.
