2. The petitioner has preferred this application for grant of regular bail in connection with Town P.S. Case No. 773/2023, NDPS Case No. 182/2023 dated 24.09.2023 registered for the offences punishable u/ss 8(c), 21(b) of the NDPS Act.

3. As per the prosecution case, total 5.339 gms. of smack like substance kept in 13 Pudias (small packets of paper) was recovered from the possession of the petitioner.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.60785 of 2025(2) dt.15-09-2025 2/2 this case. The seized contraband is less than the commercial quantity. The petitioner has three criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 25.09.2023.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that the petitioner had no any valid authorization for keeping the said contraband.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Muzaffarpur in connection with Town P.S. Case No. 773/2023, NDPS Case No. 182/2023.

7. The application stands allowed.
