JUSTICE SHIVAJI PANDEY ORAL ORDER 04-11-2015 Heard learned counsel for the petitioner and the State. In this case, petitioner is seeking bail in Chatouni P.S.Case No. 41 of 2014 registered u/s 379 IPC. Allegation has been made that the informant had kept money in dickey of the motor-cycle. He had kept the motor-cycle out side the house and had gone for some work there. In the mean time, the money kept in the dickey was taken away. During investigation Police found involvement of the petitioner. Counsel for the petitioner submits that no one had seen the petitioner taking away the money and only on the basis of suspicion, petitioner has been roped in this case. Petitioner has 16 cases over his head. He is in custody since 12th November 2014 in the present case.

No.49134 of 2015 (2) dt.04-11-2015 2/2 Looking to the period of custody, petitioner Abhay Singh is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rajeev Kumar No.IV, J.M. 1st Class, Sadar, Motihari, East Champaran in connection with Tr.No. 8160 of 2015, arising out of Chatouni P.S.Case No. 41 of 2014 subject to the conditions that :

(i) one of the bailors will be a close relative of the petitioner, (ii) if the petitioner would be found involved in similar type of case in future, prosecution will be at liberty to file application for cancellation of bail and the court below will pass necessary order, including cancellation of bail bonds, and (iii) the petitioner would co-operate and if the petitioner will fail to co-operate in the proceeding of the court and will remain absent for two consecutive dates without reasonable explanation, the court will pass appropriate order, including cancellation of bail bonds.
