JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with S.K.Puri Police Station Case No. 235 of 2016 registered for the offences punishable under Sections 354, 341, 504, 506 and 34 of the Indian Penal Code.

Petitioner happens to be tenant of the informant and from perusal of the written report, it would appear that a dispute took place between the informant and petitioner on the point of payment of the rent and in that course, petitioner pushed the informant from the shop.

Submission on behalf of the petitioner is that all the sections are bailable in nature, except section 354 of the Indian Penal Code which is not applicable in the facts and circumstances

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, 1st class, Patna in S.K.Puri Police Station Case no. 235 of 2016, subject to condition as laid down under Section 438(2) of the Cr.P.C.
