2. Heard learned counsel for the petitioners and learned A.P.P. for the State.
3. Petitioners seek regular bail in a case registered for the offences punishable under Sections 103(1) and 3(5) of the BNS and Section 27 of the Arms Act.
4. According to the F.I.R., the informant suspects that all the named accused persons, in conspiracy with unknown individuals, murdered her husband with the intention of
Patna High Court CR. MISC. No.57322 of 2025(4) dt.20-11-2025 2/2 unlawfully acquiring her property and cash.
5. Learned counsel for the petitioners submits that informant is not an eye witness to the alleged occurrence and only suspicion has been raised against these petitioners. During course of investigation, no material has come to suggest the active participation of the petitioners in the alleged occurrence. petitioners claim clean antecedent. Petitioner, namely, Suraj Kumar is in custody since 16.05.2025 and petitioner, namely, Om Prakash Prasad is in custody since 31.07.2024.
6. Learned A.P.P. for the State vehemently opposed the bail application.
7. Considering the nature of allegation, clean antecedent and period of custody, the bail application is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of S.D.J.M., Sadar, East Champaran, Motihari in connection with Pipra P. S. Case No. 194 of 2024.
