JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-09-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Triveniganj P.S. Case no. 225 of 2017, registered under Section 366/34 of the Indian Penal Code.
The accusation is of kidnapping of marriage daughter of the informant by five accused named in the F.I.R. including the petitioners for the purpose of rape in the evening of 05.07.2017 at 07.00 P.M.
Learned counsel for the petitioners submits that, in fact, daughter of the informant was kidnapped by Mukesh Kumar, son of the petitioners and Pramod Kumar. The petitioners being the parents of Mukesh have falsely been implicated in this case. Moreover, the victim has disclosed in her statement recorded under Section 164 of
Patna High Court Cr.Misc. No.42290 of 2017 (2) dt.19-09-2017 2/2 Cr.P.C. Pramod Kumar and Mukesh Kumar son of the petitioners forcibly took in the vehicle, but she has not disclosed the name of the petitioners having hand in her kidnapping.
Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M-1st, Supaul in connection with Triveniganj P.S. Case No. 225 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
