JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 03-11-2015 Petitioners apprehend their arrest in a case under section 307 and other allied sections of the Indian Penal Code. It is alleged that the petitioners and two ladies armed with Lathi and iron rod came to the house of the informant and assaulted him, his wife and daughter as the informant stopped the accused side from taking water from his Hand pump. The petitioners submit that the occurrence took place for a trivial issue, allegation is not specific rather general in nature, injuries sustained by the prosecution side are simple in nature and two ladies accused have already been allowed anticipatory bail.
In the facts of the case, in case of surrender, let all the three petitioners named above, be released on bail on furnishing
Patna High Court Cr.Misc. No.48730 of 2015 (2) dt.03-11-2015 bail bond of Rs.5,000/- each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif in Deepnagar Police station Case No. 309 of 2015.
Petitioners would not be absent physically for more than two consecutive dates at a stretch till two witnesses are examined in the trial.
