====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 29-04-2023 Heard Mr. Karandeep Kumar, learned Counsel appearing on behalf of the petitioner and Mr. Bharat Bhushan, learned A.P.P. appearing on behalf of the State.

2. The petitioner seeks pre-arrest in connection with Sangrampur P.S. Case No. 274 of 2021 registered for offence punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act and Section 67 of the Information Technology Act.

3. Learned Counsel appearing on behalf of the petitioner submitted that the petitioner is innocent and nothing was recovered from his possession. He further submitted that only allegation is that the photograph of the petitioner with AK47 was received on Whats App of the S.H.O. The similarly situated co-accused person namely, Pankaj Jha @ Vinay Kumar

Patna High Court CR. MISC. No.61893 of 2022(2) dt.29-04-2023 2/2 Jha has already been granted anticipatory bail vide order dated 16.01.2023 passed in Cr. Misc No. 50306 of 2022.

4. Learned A.P.P. appearing on behalf of the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.

5. Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand Rupees Only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, 1st Class, East Champaran, Motihari in connection with Sangrampur P.S. Case No. 274 of 2021, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Purnendu Singh, J) nilmani/minu U T
