JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 29-08-2017 Heard learned counsel for the petitioner, learned counsel appearing on behalf of O.P. No.2 and the learned A.P.P. for the State. The petitioner apprehends his arrest in connection with Tajpur P.S. Case no. 285 of 2016, registered under Section 498(A) of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. The accusation is of torturing of informant due to nonfulfillment of demand of Rs. 5 Lakhs as dowry and drove her from matrimonial house snatching her personal belongings. Learned counsel for the petitioner submits that on the joint request of the parties, the matter was referred to the Mediation Centre, Patna High Court for settlement in between petitioner and O.P. No.2, who are husband and wife, but the matter could not be settled due to rigid attitude of the O.P. No.2. Further submission is that in the
Patna High Court Cr.Misc. No.7219 of 2017 (6) dt.29-08-2017 2/2 Mediation Centre, the O.P. No.2 demanded Rs. 30,00,000/- for settlement, which would appear from the Mediator's report dated 22.08.2017.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-I, Samastipur in connection with Tajpur P.S. Case No. 285 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
